Terms of Service - EchoVCast

1. Agreement to Terms

By purchasing, downloading, installing, or using the EchoVCast software ("Software") or accessing the EchoVCast website at echovcast.com ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software or Website.

EchoVCast is operated as a sole proprietorship based in the United States ("we," "us," "our").

2. Description of Service

EchoVCast is a desktop application that provides real-time voice transcription and translation for live audio. The Software captures audio from your microphone or system audio (such as livestreams, voice calls, or videos), transcribes it locally on your device, translates the transcribed text via our servers, and outputs the results for use with streaming software such as OBS or for communicating with others across languages.

3. Subscription and License

Access to EchoVCast requires an active paid subscription. Upon purchase, you receive a license key that grants you a non-exclusive, non-transferable, revocable right to use the Software for personal, non-commercial use only.

Each license supports up to 2 devices simultaneously.
Subscriptions are available on monthly or annual billing cycles.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
You may not share, resell, or transfer your license key to another person.

4. Account Registration

Account creation is performed through the EchoVCast desktop application and requires a valid license key. You are responsible for maintaining the security of your account credentials. You must provide a valid email address and confirm it before your account is fully activated.

You may not create multiple accounts for the same license key. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software. The Software is proprietary and closed-source.
Attempt to circumvent license validation, device limits, or rate limits.
Use the Software for any unlawful purpose.
Interfere with or disrupt the operation of our servers or services.
Share your license key or account credentials with others.
Use automated tools to access the service beyond normal application usage.
Use the Software for commercial purposes, including but not limited to reselling translations or providing translation services to third parties.

6. Payment and Billing

All payments are processed through LemonSqueezy, our payment provider. By purchasing a subscription, you also agree to LemonSqueezy's terms of service. Prices are listed in USD and may be subject to applicable taxes.

If payment fails, your subscription may enter a grace period. If payment is not resolved within the grace period, your access to translation features will be suspended.

During the beta period, EchoVCast is offered at a reduced introductory rate. Standard pricing after the beta period will be $6.99/month and $69.99/year. Subscribers who maintain an active beta subscription without cancellation will continue to be charged at the beta rate for as long as their subscription remains active ("grandfathered rate"). If a beta subscription is cancelled, any future subscription will be at the then-current standard price.

7. Refund Policy

Due to the digital nature of the Software and the costs associated with providing the translation service, all sales are final. No refunds will be issued after purchase.

You may cancel your subscription at any time to prevent future charges. Upon cancellation, you retain access to the Software until the end of your current billing period.

8. Translation Accuracy

EchoVCast uses automated speech recognition and machine translation technology. We do not guarantee the accuracy, completeness, or reliability of any transcription or translation output. The Software is provided as a tool to assist with communication, and you are responsible for reviewing and verifying any critical output.

9. System Requirements

The Software requires a Windows 10 or later computer. An NVIDIA GPU with CUDA support is recommended for best performance, but a CPU-only mode is also available. It is your responsibility to ensure your system meets the minimum requirements before purchasing. System requirements are listed on our pricing page.

10. Intellectual Property

The Software, Website, and all associated content, code, and materials are the intellectual property of EchoVCast. Your subscription grants you a license to use the Software; it does not transfer any ownership rights.

11. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. The translation service depends on third-party infrastructure and may experience downtime. We are not liable for any losses resulting from service interruptions.

12. Termination

We reserve the right to suspend or terminate your account and revoke your license at our discretion if you violate these Terms. Upon termination, your right to use the Software ceases immediately.

13. Limitation of Liability

To the maximum extent permitted by law, EchoVCast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Software or Website. Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Software and Website are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Software or Website after changes are posted constitutes your acceptance of the revised Terms.
